What Is an Employer of Record in Indonesia, and Do You Need One?

what is an employer of record

An Employer of Record (EOR) is an Indonesian company that legally employs your staff while you manage their work. The EOR’s name is on the employment agreement, the BPJS registrations and the PPh 21 tax filings. You choose the people, direct the work and set the pay. In Indonesia the arrangement is often called payroll parking, and it is the practical way to have a team working in Jakarta before you commit the capital a foreign-owned company requires.

The problem an EOR solves in Indonesia

Setting up a PT PMA is a capital decision as much as a legal one. The investment plan must exceed IDR 10 billion per business line and location, and BKPM Regulation 5/2025 requires at least IDR 2.5 billion of paid-up capital, locked for twelve months. Registration through the OSS system is quick for low-risk sectors, but the notary, Ministry of Law ratification, tax registration, bank account, BPJS employer registration and, for expatriates, the RPTKA process all follow. Then comes a labour framework with regulated contract types, high severance and payroll tax mechanics that changed in 2024.

An EOR already has the entity, the registrations and the payroll. A first hire can start within a week or two, and the question of whether Indonesia justifies IDR 10 billion can be answered with real revenue rather than a forecast.

EOR, staffing agency or your own PT PMA

A staffing or recruitment agency finds candidates. Once you hire them they are your employees, or the agency’s for a short assignment. The agency’s role ends at placement.

An Employer of Record employs the people you have chosen, indefinitely, and carries the employer obligations under the Manpower Law as amended by the Job Creation Law, PP 35/2021, the BPJS laws and the income tax law. You direct the work.

Your own PT PMA gives you full control and is the right long-term home for manufacturing, a large office, or any business that needs to hold licences, import rights or land.

Companies commonly use all three in sequence: an agency to find the country head, an EOR to employ the first team, and a PT PMA once the case is proven, with staff transferring across.

What the EOR handles in Indonesia

  • Contracts. Correct classification as PKWT (fixed-term, up to five years in total, with an end-of-contract compensation payment) or PKWTT (permanent, up to three months’ probation), in Bahasa Indonesia. Getting this wrong deems the contract permanent.
  • BPJS. Kesehatan at 4% employer and 1% employee on salary capped at IDR 12 million; Ketenagakerjaan with JHT 3.7%, JP 2%, JKK 0.24% to 1.74%, JKM 0.3% and JKP 0.36% from the employer.
  • Tax. Monthly PPh 21 under the TER tables, the December true-up, and 1721-A1 slips.
  • Wages and allowances. Compliance with the provincial UMP and city UMK minimums (Jakarta’s 2026 UMP is IDR 5,729,876), THR paid on time, and the allowance-heavy structure Indonesian packages usually take.
  • Working time. The 40-hour week, overtime at 1.5 and 2 times on working days and higher on rest days, 12 days’ leave after a year, and joint leave days.
  • Exit. Severance, long-service pay and compensation of rights under PP 35/2021, calculated and documented so that termination does not become a dispute at the Industrial Relations Court.

The benefits, honestly stated

Capital efficiency comes first in Indonesia: you can employ people without committing IDR 10 billion. Speed is second: weeks rather than months. Risk transfer is third: severance in Indonesia is among the highest in ASEAN and the contract classification rules are unforgiving, so an EOR that gets contracts and exits right protects you from expensive mistakes. Compliance is fourth: BPJS rates, minimum wages and PPh 21 mechanics have all moved in the past two years and an EOR absorbs those changes.

The trade-offs: an EOR is not the vehicle for a factory, for a business that needs its own licences or import rights, or for a headcount that will quickly run into the dozens. In those cases, start the PT PMA early and use the EOR as the bridge.
